The Texas Deceptive Trade Practices Act (DTPA) allows consumers to recover for misconduct by the seller of a good or service.
The definition of “consumer” under the DTPA is very broad, and can usually include a business as long as their assets do not exceed the statutory amount stated in the Act.
Many common DTPA disputes involve:
- Home Builders
- Automobile Dealers
- Insurance Companies
Many actions such as common-law fraud, and breach of warranty can be brought under the DTPA, but with more meaningful damages. In addition to those, there are numerous bad acts by sellers, which are specifically recoverable under the DTPA.
